These Terms of Use govern access to and use of the Gifts City marketplace platform located at www.giftscity.in (“Platform”).

The Platform is owned and operated by PR Krishna Novelties Private Limited, having its registered office at ‘WZ-114G, 2nd Floor, Pusha Road, Todapur, New Delhi – 110012, India’.

By accessing, browsing, or using the Platform in any manner, including purchasing products, you agree to be bound by these Terms of Use, along with all applicable policies including the Privacy Policy, Exchange Policy, and other guidelines published on the Platform, as amended from time to time.

1. Definitions

  • “User” / “You” / “Your” refers to any natural or legal person who accesses or uses the Platform or purchases products.

  • “Gifts City”, “We”, “Us”, “Our” refers to PR Krishna Novelties Private Limited and its affiliates.

  • “Products” refers to goods listed and sold on the Platform.

2. Modification of Terms

We reserve the right to modify, amend, add, or remove portions of these Terms of Use at any time without prior notice. Your continued use of the Platform following such changes constitutes acceptance of the revised Terms.

3. User Account, Password & Security

  • You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

  • Any information provided by you must be true, accurate, complete, and current.

  • Gifts City reserves the right to suspend or terminate accounts found to be inaccurate, misleading, fraudulent, or in violation of these Terms.

  • Your registered email address is your primary identifier on the Platform. You must keep your contact details updated at all times.

  • You agree to notify Gifts City immediately of any unauthorized use or security breach of your account.

4. Nature of Services Offered

Gifts City is an e-commerce platform exclusively engaged in the sale of physical products.

  • The Platform does not provide services.

  • All purchases are subject to product availability and successful payment authorization.

  • Product descriptions, images, specifications, and prices are provided on a best-effort basis and may contain minor variations.

Gifts City does not guarantee that product descriptions or content are error-free and shall not be liable for such inaccuracies.

5. No Returns / No Refunds Policy

🚫 No Returns or Refunds

  • All sales are final.

  • Returns and refunds are not permitted under any circumstances, including but not limited to change of mind, dislike, or incorrect ordering by the user.

🔁 Exchange Policy (Limited)

  • Products may be exchanged only for the same item (same product, different size and/or color).

  • Exchange requests must be raised within 7 days from the date of delivery.

  • Exchanges are subject to stock availability.

  • The product must be:

    • Unused

    • Unwashed

    • Undamaged

    • With original tags and packaging intact

If the exchanged product fails quality checks, the exchange request will be declined, and the product will be shipped back to the customer. No refund shall be issued in such cases.

Failure to accept re-shipment will not entitle the user to a refund or replacement.

6. Pricing, Availability & Order Cancellation

  • Prices displayed may be affected by technical or typographical errors.

  • Gifts City reserves the right to cancel any order due to pricing errors, stock unavailability, or suspected fraudulent activity.

  • In such cases, if payment has been captured, it shall be reversed as per applicable payment gateway timelines.

7. Platform Role & Limitation

Gifts City acts solely as an online retail platform and:

  • Does not guarantee uninterrupted access

  • Is not responsible for delays caused by logistics partners

  • Is not liable for manufacturer defects beyond exchange eligibility

8. User Conduct

You agree not to:

  • Upload or transmit unlawful, harmful, misleading, abusive, defamatory, obscene, or infringing content

  • Impersonate any individual or entity

  • Engage in fraudulent, bulk, or resale activities

  • Use automated tools, bots, or scraping mechanisms

  • Attempt unauthorized access to the Platform or its systems

Gifts City reserves the right to cancel orders or terminate accounts involved in suspicious or abusive behavior.

9. Bulk & Fraud Orders

Orders may be classified as bulk or fraudulent if they involve:

  • Commercial resale intent

  • Excessive quantities

  • Repeated exchange abuse

  • Invalid contact or address details

  • Use of loopholes or promotional misuse

Such orders may be cancelled without notice, and promotional benefits forfeited.

10. Payments

  • All payments must be made in Indian Rupees (INR).

  • Gifts City is not liable for payment failures, authorization issues, or bank declines.

  • Cash on Delivery may be restricted for high-risk accounts.

11. Disclaimer of Warranties

All products and content are provided “as is” and “as available”, without warranties of any kind, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Gifts City shall not be liable for indirect, incidental, consequential, or punitive damages.

  • Liability, if any, shall not exceed the value of the product purchased.

13. Termination

Gifts City may suspend or terminate accounts without notice if these Terms are violated. Transaction records may be retained for legal or regulatory compliance.

14. Jurisdiction & Sale Territory

  • Products are sold only within India.

  • These Terms are governed by the laws of India.

  • Courts in Delhi shall have exclusive jurisdiction.

15. Delivery Disputes

Any delivery-related issues must be reported within 5 days from the delivery date shown on the Platform. Claims raised after this period shall not be entertained.

16. Charges & Fees

Gifts City may levy handling or convenience fees on low-value orders as detailed in the FAQs. Such fees are non-refundable.

17. Acceptance

By using the Platform, you acknowledge that you have read, understood, and agreed to these Terms of Use.
